The fan who allegedly hurled his cell phone at pop star Bebe Rexha — hitting her in the face during a Manhattan concert last month — anticipates he’ll eventually have all criminal charges dropped, his attorney said Monday.

Nicholas Malvagna’s lawyer, Todd Spodek, alluded to a plea deal being discussed with prosecutors as his client returned to Manhattan Criminal Court for the assault case over the June 19 incident at The Rooftop at Pier 17 in the South Street Seaport.

“At this point we have not received any evidence to support the charges and are considering all relevant motions,” Spodek told The Post after the brief hearing.

“I anticipate a resolution short of trial, with all of the criminal charges being ultimately dropped.”

Malvagna, 27, wore a black suit, blue shirt and dark blue tie, while hiding behind a purple medical mask — while his parents attempted to shield him from reporters and photographers following the court appearance.

The New Jersey man has said he was attempting to get Rexha, 33, to take a photo with his phone when he chucked it at her during the performance — leaving her bloodied, with a black eye, and in need of stitches.

He has been charged with assault, aggravated harassment, attempted assault and harassment.

During his arraignment last month, Manhattan prosecutors said Malvanga told cops that he was just trying to take part in a TikTok trend when he tossed his phone at the the Brooklyn-born singer.

“It’s a TikTok trend where you throw your phone onto the stage, and a celebrity passes it and takes a selfie,’” Malvagna told arresting officers, according to a prosecutor.

“‘I thought she was looking in my direction. I was about two rows back, but instead of my phone landing right next to her, my phone hit her in the face,’” Malvagna allegedly told cops.

He was freed without bail.

“As a fan, Mr. Malvagna’s sole intention was to have Ms. Rexha take photos with his phone and return it as a keepsake. It was never his intention to injure Ms. Rehxa,” Spodek said in a statement at the time.a
